Membership Terms & Conditions

We are delighted that you've chosen to enroll in one of our Membership Programs in accordance with the terms and conditions provided below. The AutoCareAF Membership Programs (referred to as the "Program" or "Membership") are administered by AutoCareAF (referred to as the "Company," "us," or "AutoCareAF"). By enrolling in a Program or utilizing the benefits tied to it, you (referred to as "you" or "Member") agree to the following Terms and Conditions.

PLEASE CAREFULLY REVIEW THESE MEMBERSHIP TERMS AND CONDITIONS AS THEY HAVE IMPACT ON YOUR RIGHTS AND RESPONSIBILITIES. YOUR PARTICIPATION IN ANY AUTOCAREAF MEMBERSHIP PROGRAM CONSTITUTES AGREEMENT TO THESE MEMBERSHIP TERMS. YOUR MEMBERSHIP IS ALSO GOVERNED BY AUTOCAREAF'S TERMS OF USE AND PRIVACY POLICY, BOTH ACCESSIBLE AT AUTOCAREAF.COM.

THESE MEMBERSHIP TERMS AND CONDITIONS CONTAIN CLAUSES THAT (I) LIMIT OUR LIABILITY TOWARDS YOU, (II) WAIVE YOUR ENTITLEMENT TO A JURY TRIAL, (III) MANDATE SETTLING DISPUTES WITH US INDIVIDUALLY THROUGH FINAL AND BINDING ARBITRATION, RATHER THAN AS PART OF A CLASS OR REPRESENTATIVE ACTION, AND (IV) ESTABLISH AUTOMATIC ANNUAL RENEWAL OF YOUR MEMBERSHIP. In the context of AutoCareAF's Membership Terms and Conditions, the term "Member" refers to a person who has enrolled in any of AutoCareAF's membership Programs as outlined here. This definition also encompasses any secondary member that the main member has granted permission to utilize the membership. The primary member holds exclusive authority to modify the membership, as well as to ask for and obtain relevant information.

These Terms and Conditions Are Subject to Change

AUTOCAREAF RESERVES THE RIGHT TO ALTER MEMBERSHIP TERMS AND CONDITIONS AT ANY TIME, WITHOUT NOTIFYING YOU. YOU ARE REQUIRED TO REVIEW MEMBERSHIP TERMS AND CONDITIONS FOR ANY REVISIONS. YOUR ONGOING UTILIZATION OF YOUR MEMBERSHIP (OR IN THE INSTANCE OF AN EXPIRED MEMBERSHIP) SIGNIFIES YOUR APPROVAL OF THE MODIFICATIONS. IF YOU DISAGREE WITH THESE REVISIONS, YOU MUST INITIATE MEMBERSHIP CANCELLATION. It is your obligation to stay informed about all the terms of the Program and any adjustments, alterations, or new elements added to the Program you are a member of.

The Company holds exclusive authority to make changes, additions, or deletions to any part of the Program rules, terms, conditions, and benefits, at its sole discretion and without prior notice. These changes could potentially impact the value of already earned points and/or benefits. The Company also reserves the right to end any membership, decrease accumulated points, or revoke benefits due to suspected breaches of these Terms and Conditions, attempted fraudulent actions, misconduct, engagement in commercial or resale activities, or any other reason deemed reasonable solely by the Company

Eligibility And Enrollment

The Membership Basic and Membership Plus are fee-based membership programs that have the potential to renew automatically each year unless cancelled. The availability of both the membership Basic and Membership Plus is not permitted in areas where it is prohibited by law.

​

Through the act of purchasing a membership, you are entering into a legally binding agreement based on the outlined Terms and Conditions. Additionally, you are consenting to receive communications via methods such as email messages, text messages, push notifications, or other forms of messaging from AutoCareAF.

​

The Company cannot be held accountable for communications, offers, or rewards dispatched to email addresses that are outdated or have been altered. All Program-related communications will be directed to the primary member's currently registered email or mobile phone, as provided in the member's membership account. It is the responsibility of members to maintain accurate and up-to-date email and mobile phone details. Whenever a member seeks information about points, AutoCareAF might request specific security-related inquiries to confirm the member's identity.

Each individual, email address, and phone number is restricted to participating in only one Program.

You consent to refrain from selling, transferring, or allocating your account or the points linked to your membership, along with any membership privileges. The points and benefits are not considered your personal possessions and cannot be inherited, exchanged, bought, assigned, or traded. If you are an online user, it is essential to recognize that you hold the sole responsibility for safeguarding the confidentiality of your login credentials and for limiting access to your computer or other devices to prevent unauthorized entry into the account linked to your membership.

Membership Tiers & benefits

Membership Basic

The Membership Basic costs $100 per year and is paid in advance. This membership offers Basic Members the following advantages throughout the duration of their membership period:

You earn ONE AutoCareAF Point for every $10 spent, following discounts and prior to tax and destination fees, when purchasing services, add-ons, or products offered by our company. These rewards can be accumulated through purchases made on our official website or in-person.

The Basic Membership covers a single primary membership and does not encompass a secondary membership.

Membership Plus

Membership Plus includes all the privileges and entitlements of Basic Membership. It is a $200 annual membership that is paid in advance. Moreover, Membership Plus confers extra advantages upon its members throughout the duration of their membership term, which encompass:

You earn ONE AutoCareAF Point for every $10 spent, following discounts and prior to tax and destination fees, for every transaction (Except for the excluded purchases mentioned below) conducted either in person or on our Company website. AutoCareAF points are rounded up to the nearest two decimal places for all qualifying transactions.

Applicable To All Membership Programs

We reserve the right to modify Membership Program fees or benefits at our sole discretion. If any changes occur, your current membership fee remains valid for the rest of your Membership Term. Upon renewal, the new membership fee will apply.

​

You can use any credit or debit card accepted by the Company to pay your Membership Fee. If the card we have on record is declined, please update it promptly to avoid Membership cancellation. Should you provide a new card that is successfully charged, your Membership will continue from the original sign-up date, not the charge date.

​

The Membership Plus offers a primary membership along with a secondary membership, which comes at no extra cost. This secondary membership can be given to another member as per the request of the primary member during enrollment or later. Additionally, in any given transaction, only one AutoCareAF membership is eligible to earn points, and either the primary or secondary member can utilize these points. Moreover, the primary member has the option to replace the secondary member, but this can happen no more frequently than every three months. To do so, they must get AutoCareAF's approval by sending an email to AutoCareAF@info.com. It's important to note that any changes in membership designation might take up to 10 business days to be implemented.

Both your Membership Basic and Membership Plus have the potential to renew annually on an automatic basis. If you wish to avoid this automatic renewal, you have the option to opt out via the AutoCareAF Website or by getting in touch with AutoCareAF through email at AutoCareAF@info.com. When emailing, please ensure that the subject line includes "Cancel Auto Renew." In the event that you do not communicate your decision to opt out prior to the renewal membership fee being charged, it's important to understand that your membership will automatically extend, and you grant us authorization (unless required by applicable law, and without prior notice to you) to gather the current applicable membership fee (currently set at $100 for Membership Basic and $200 for Membership Plus, but subject to change) along with any relevant taxes. We will use the credit or debit card details we have on file for you.

Accumulating Points

In order to accumulate Points, participants of the Program need to verify their identity during the purchase process, whether it's in person or online, using one of the validation methods outlined below:

Membership validation for any in person or online transaction is exclusively possible through one of three designated methods, without any exceptions.
1. You share your email with the service provider for identity verification.
2. If your car is connected, we will cross-verify the VIN number and your name for authentication.
3. Be logged in when performing a purchase on our website.

​

For e-commerce transactions, it's necessary to be logged into your account using your email linked to your membership.

​

Please be aware that members will not be provided with physical or digital membership cards. Instead, they will receive an email confirmation and proof of purchase through the AutoCareAF website when logged into their account.

​

(referred to as "Validation Methods") within any of our membership programs.

Failure to utilize one of the Validation Methods during the purchase will result in the non-accumulation of Points for that transaction, and/or the ineligibility to receive membership benefits. Nevertheless, you have the option to add purchases to your Membership Account within ten days of the original transactions by sending an email to AutoCareAF@info.com and furnishing adequate information to AutoCareAF for purchase identification. The Company holds full discretion in evaluating whether a reported purchase is eligible for Points.

Points cannot be acquired for purchases of, gift cards, memberships, covering destination fees, or paying retainer fees in cases where the associated service remains incomplete. AutoCareAF retains the authority to decide whether to include, alter, or remove qualifying limitations on serivce categories or specific services from the mentioned list, without prior notification.

​

Points are accrued once a purchase is completed, delivered, and our team has left the customer's location. These points are exclusively earned through in-person or online purchases made directly on the AutoCareAF Website. Transactions conducted via third-party platforms are not eligible for point accumulation. The accumulated points are calculated after accounting for any applicable discounts.

​

AutoCareAF is committed to making reasonable efforts to address any Points dispute you may have. To ensure timely resolution, you should inform AutoCareAF of the dispute within 14 days from the purchase or utilization of the Points. Failing to do so within this timeframe will result in the forfeiture of your right to dispute any issue related to Points purchases or usage. AutoCareAF might request written confirmation of the dispute, along with the relevant purchase receipt. Failure to provide the requested confirmation, necessary evidence, and a valid receipt could lead to the discontinuation of further investigation.

​

Once the investigation is concluded, AutoCareAF's obligations will cease, even if you decide to reintroduce the same dispute at a later time. It is your responsibility to furnish convincing evidence to persuade AutoCareAF in all dispute matters, and there exists a rebuttable assumption that all entries made to your Account were approved by you.

​

Points Expiry and Point Refund

AutocareAF Points will automatically expire if no purchases are conducted using your membership account for twelve (12) continuous months after the existing recorded expiration date on your account.

In cases of refunds or other credits, the Points accrued from a purchase will be subtracted. The deduction will be equivalent to the Points initially earned for the original purchase and will be taken from your account.

Point Redemption

Points are applicable for use in making eligible purchases when booking manually or through transactions conducted on the AutoCareAF website, as determined by AutoCareAF's guidelines. These Points are non-transferable, hold no intrinsic cash worth, cannot be considered as legal tender, and do not establish any form of property or other interests. AutoCareAF Points are exclusively usable for authorized purchases carried out via manual bookings or the AutoCareAF Website. These Points can be employed as a form of payment for approved purchases, with the valuation of 1 AutoCareAF Point equating to $1.00.

Membership Benefits

Members of AutoCareAF's paid membership programs are entitled to the following benefits based on their selected tier. All benefits must be used within the active membership year. Unused benefits do not roll over, and no benefit has cash value unless explicitly stated.

​

Basic Plan ($100/year)

  • 1 Point per $10 Spent: Points accrue on qualifying purchases made in person or through the AutoCare website.

  • Weekend Priority Booking: Basic members receive booking priority on Saturdays and Sundays.

  • Free Quick Refresh Wash (1x/year): One Quick Refresh service per year included; must be scheduled and redeemed by the primary member.

  • Free Carpet Protection (1x/year): Applied during any interior service upon request.

  • $10 Credit After 5 Paid Visits: Automatically applied after five qualifying service visits. Not redeemable for cash.

Plus Plan ($200/year)

  • Includes All Basic Plan Benefits

  • 20% Off All Detailing Services: Valid year-round on all eligible detailing packages.

  • 15% Off All Add-On Services: Discount applied to individual services like clay bar, pet hair removal, etc.

  • 1 Free Engine Detail (1x/year): Must be scheduled in advance.

  • Free Light Stain Removal: Available once per visit when booked with an interior detail. Not valid as a standalone appointment.

Consent/Confidentiality/Withdrawal

By submitting your enrollment details, you are indicating your choice to receive messages, which may include emails and texts, from AutoCareAF. You are also authorizing us to utilize your transaction and profile data in order to deliver personalized Program-related messages and exclusive offers.

Even if members have chosen not to receive marketing emails, they can still actively participate in the Program and receive communications related to the specific Program they are enrolled in. By agreeing to this, you are granting AutoCareAF the permission to send communications related to the Program through various channels, such as mail, phone, email, and other methods. This includes your consent to receive emails, text messages, push notifications, and other types of communications using any of the email addresses or phone numbers you have provided. This agreement covers a range of communications, including those related to transactions, customer service, orders, and order-related matters. Additionally, it encompasses communications for advertising, marketing, promotions, or other purposes that you have requested or given consent for, all related to your Account and your membership enrollment in one of our offered programs. The frequency of these messages may vary.

AutoCareAF cannot be held accountable for the loss or non-delivery of communications caused by email addresses and/or phone numbers that are incorrect or outdated.

​

Every member has the choice to stop receiving messages from us regarding marketing, advertising, promotions, and similar activities. If you wish to stop or opt out, kindly send an email to AutoCareAF@info.com

Notice of Financial Incentive

As part of our Program, we occasionally provide Members with financial rewards and/or variations in pricing or services ("Incentives").

In order to provide these Incentives, it is necessary for us to monitor the personal information you provide during registration or when participating in activities to accrue Points. This information includes purchase records, date of birth, involvement in events, and interactions with the Company as outlined in these Terms ("Program Data").

Payment Terms

By agreeing to our Terms and Conditions, you are giving your consent for us to retain your payment details for future utilization at AutoCareAF, following our regular procedures.

Limited Liability

Except where mandated by law, AutoCareAF and its affiliates, officers, directors, employees, service providers, or agents will not be held accountable to you or anyone acting on your behalf for matters relating to the Program or these Terms and Conditions. This includes, but is not restricted to, Program utilization, product redemption, or benefit acquisition. However, it is important to note that AutoCareAF's liability, as well as that of any employee representatives, concerning the Program, will be restricted to the total Points you have earned as outlined within these Terms and Conditions.

Taxes

Any tax obligation arising from your involvement in the Program or the utilization of Points is your responsibility. It is recommended that you seek guidance from a tax advisor regarding these potential tax implications.

​

Conflicts

These Terms and Conditions take precedence over any prior membership terms and conditions. In the event that any portion of these Terms and Conditions contradicts relevant laws, that particular provision will be considered as removed from these Terms and Conditions, while the rest of the terms will continue to be valid.

Consent to Arbitration & Relinquishment of Specific Rights

You and the Company mutually agree that, with the exception of the circumstances below, any disagreements (referred to as "Disputes" hereafter) between us (including any disagreements involving you and any of our affiliates) will be resolved through conclusive and individual arbitration rather than going through court proceedings. Both you and the Company hereby relinquish any entitlement to a jury trial or to the collective resolution or judgment of any Dispute.

Any Dispute, whether arising in connection with these Terms, your membership, your use of the AutoCareAF site or services, claims based on contract, tort, statute, fraud, misrepresentation, or any other legal principle, whether in law or equity, and including all common law claims and claims associated with personal injury such as negligence, gross negligence, physical harm, emotional distress, and exemplary or punitive damages, will be governed by the Federal Arbitration Act ("FAA") and California law. This applies regardless of the party involved, whether it's you, AutoCareAF, or any of our affiliates. This shall be further detailed as follows.

This stipulation does not impede either you or AutoCareAF, or any of our affiliates, from pursuing all available administrative, judicial, or alternative remedies for the violation of a registered patent, trademark, service mark, or copyright. Either party shall also be entitled to seek injunctive relief to prevent breaches of the provisions within these Terms and Conditions, specifically enforcing these Terms and Conditions and all their provisions. This can be pursued without requiring a bond or other security in any federal or state court with jurisdiction in the United States. This remedy is supplementary to any other legal or equitable remedies that either you or AutoCareAF might be entitled to.

You should be aware that arbitration involves no judge or jury, and the process entails less discovery and appellate review compared to court proceedings. Furthermore, you acknowledge and agree that Disputes cannot be arbitrated or litigated on a class-action basis. Neither you nor the Company are permitted to act as a representative of a class or as a private attorney general in relation to any Dispute.

Any Dispute will be exclusively resolved according to the Arbitration Rules of ADR SERVICES, INC ("ADR Rules"). The arbitration itself will take place in Century City, California, and will be presided over by a sole arbitrator appointed by ADR SERVICES, INC, as per the ADR Rules. The arbitrator's decision resulting from such arbitration will be conclusive and binding on both you and AutoCareAF. It can be enforced in any court with proper jurisdiction. The arbitrator is not authorized to consolidate or combine claims from other parties that might be in a similar situation.

In the arbitration, the arbitrator may award the same damages or remedies available under relevant laws, including injunctive and declaratory relief, as if the case were being heard in court on an individual basis. However, it's important to note that the arbitrator is not authorized to issue a "public injunction." Such an injunction can only be granted by a federal or state court. If either party seeks a "public injunction," all other claims and requests for relief must first be settled through arbitration, and any claim or request for a "public injunction" in federal or state court must be put on hold until the arbitration process concludes. After arbitration, the federal or state court can then handle the claim or request for "public injunctive relief," with the court being legally bound by the arbitrator's decision.

This section of the Terms and Conditions will remain effective even if your membership in any Program comes to an end.

Both you and AutoCareAF also concur that the arbitration process will remain confidential. This means that the proceedings and any aspects of it (including, but not limited to, pleadings, briefs, documents exchanged, oral submissions, and awards) will not be disclosed beyond the scope of the arbitration process, unless such disclosure is legally required in conjunction with judicial proceedings linked to the arbitration. Additionally, disclosure may occur as mandated by relevant rules and regulations of securities regulatory authorities or other government agencies, or as explicitly allowed by state law.

The authority to resolve any disputes about the interpretation, applicability, enforceability, or formation of these Terms and Conditions lies solely with the arbitrator, and not with any federal, state, or local court or agency. This authority encompasses claims asserting that any or all portions of these Terms and Conditions are void or can be annulled.

If you provide substantial documentary evidence showing that the expenses associated with arbitration would be significantly higher than those of litigation, the Company will cover the administrative costs and arbitrator's fees essential for the arbitration, as deemed necessary by the arbitrator. This is to ensure that the cost of arbitration does not become a hindrance for you. You and the Company also retain the option to pursue qualifying claims in a small claims court on an individual basis, without involving class actions. Neither you nor AutoCareAF will be eligible to receive attorney fees as an award resulting from the arbitration of any Dispute.

Ability to Decline Participation in this Arbitration Agreement.

You have the option to decline the agreement to resolve any disputes through arbitration, but this choice is available only within the initial 14 days following the enrollment of the primary member in any of our Membership Programs. To exercise this option, you can send an email to the Company at AutoCareAF@info.com. In your email, please include your full name, mailing address, and the phrase "Reject Arbitration."

If any provision related to the arbitration of a dispute is determined to be invalid or unenforceable, that particular provision will have no legal effect and will be removed, while the remaining provisions concerning the arbitration of disputes will remain fully enforceable. In the event that a dispute is resolved in a court setting instead of arbitration, both you and AutoCareAF relinquish any entitlement to a trial by jury. Any waiver of a provision within these Terms and Conditions must be recorded in writing and signed by the party relinquishing such a right or requirement, in order to be valid and enforceable. This waiver will not affect any other part of these Terms and Conditions. The arbitrator has the authority to grant the same remedies or relief available under applicable law, such as injunctive and declaratory relief, as if the matter were brought before a court on an individual basis. Despite any contrary stipulations here or elsewhere, the arbitrator is not permitted to issue a "public injunction," and such an injunction can only be granted by a federal or state court. Should either party seek a "public injunction," all other claims and requests for remedies must first go through arbitration, and any request or claim for a "public injunction" in federal or state court will be put on hold until the arbitration process is finalized. Following the conclusion of arbitration, the federal or state court may then proceed to address the party's claim or request for "public injunctive relief."

Assorted Matters

AutoCareAF and its affiliates will not be held responsible for any delay or inability to perform, whether fully or partially, due to factors beyond our reasonable control, including acts of nature or other unforeseeable circumstances. Additionally, it's important to note that certain services or products might not always be available for purchase continuously.

AutoCareAF's websites utilize "cookies," which are small pieces of data sent from a web server to your browser and stored on your computer's hard drive. These cookies serve various purposes, including recognizing you as an AutoCareAF user, customizing our offerings to match your preferences, estimating our customer base, monitoring your participation in our promotions, benefits, and giveaways, as well as analyzing your browsing behavior. Adjusting your browser settings to decline cookies or receive notifications before receiving them is generally possible, allowing you to choose whether to accept them. AutoCareAF will solely employ this data in an aggregated manner that does not reveal your personal identity.

Our decision not to enforce any particular right or provision stated in these Terms and Conditions does not imply that we waive the ability to enforce that right or provision at a later time.

​

We retain the option to transfer our rights and responsibilities outlined in these Terms and Conditions, including instances such as mergers, acquisitions, asset or equity sales, or legal mandates. The use of trademarks, service marks, and trade names within any Program is conducted under AutoCareAF's authorization. All trademarks, service marks, and trade names associated with AutoCareAF are the exclusive property of AutoCareAF. Without prior written consent from AutoCareAF, you are not permitted to utilize these marks.

Cessation and Relinquishment

Depending on the demands or restrictions imposed by relevant laws, AutoCareAF holds the right to discontinue any Program at any point and for any rationale, absolving AutoCareAF from any associated liability.
